?

En France, les prestataires de services sur actifs numériques (PSAN) doivent s'enregistrer auprès de l'Autorité des Marchés Financiers (AMF). L'AMF est l'autorité publique qui supervise les marchés financiers.

Les services pour lesquels un enregistrement est obligatoire sont:

  • la conservation d’actifs numériques,
  • l'achat ou de vente d’actifs numériques en monnaie ayant cours légal,
  • l'échange d'actifs numériques contre d'autres actifs numériques et
  • l'exploitation d'une plateforme de négociation d'actifs numériques.

De plus, les prestataires de services sur actifs numériques doivent également se conformer aux reglementations relatives à la lutte contre le blanchiment d'argent et le financement du terrorism (LCB/FT).

Digital assets under French PSAN legislation

In 2019, French legislation for markets in digital assets (the “PACTE law”) established an innovative regulatory framework for some crypto-assets industry actors and their supervision by French financial regulators, the Financial Markets Authority (Autorité des marchés financiers – AMF) and Prudential Supervision and Resolution Authority (Autorité de contrôle prudentiel et de résolution – ACPR).

In the scope are token issuers (see Section II.) and digital assets service providers (DASP), the so-called Prestataire de service sur actifs numériques or PSAN in French (see Section III.)

Digital assets in the sense of French law encompass two types of assets: tokens, defined by French law, and virtual currencies, described in the European regulations on Anti-Money Laundering and Combating the Financing of Terrorism (AMLD5).
